The Website is operated by Palm Lux Medical Aesthetics LLC, doing business as Palm Lux Aesthetics ("Palm Lux," "we," "us," or "our").

A provider–patient relationship is formed only when you are seen and accepted as a patient by one of our licensed providers in accordance with our practice's intake procedures.

4. Do Not Submit Health Information Through the Website

The Website is not designed or intended to collect, store, or process protected health information (PHI) or any information covered by the Health Insurance Portability and Accountability Act (HIPAA). Any health information you share with our practice is collected and handled through separate systems maintained by the practice and its providers, not through the Website.

Please do not include medical details in any Website form, message, or comment. This includes symptoms, conditions, diagnoses, medications, medical history, photographs of your body, or treatment questions about your personal health. If you want to discuss your health or a specific treatment, please call us or schedule a consultation. If you submit health information through the Website anyway, you do so at your own risk, and we may delete it without responding.

Our services are provided only to adults, and all treatment decisions are made by our licensed providers after an in-person consultation. Results vary and are not guaranteed. Every person is different. Descriptions of treatments, expected outcomes, downtime, and duration on the Website are general in nature. Photographs, videos, reviews, and testimonials on the Website or our social media show individual experiences and possible results only. They are not a promise or prediction of your results.

A consultation is required. All treatments require a consultation with a licensed provider, who will determine whether a treatment is appropriate for you. We may decline to provide any service at our discretion.

Services, pricing, and offers may change. Any services, prices, packages, memberships, or promotions described on the Website are subject to change or withdrawal at any time without notice, may be subject to additional terms, and may not be available to everyone. Nothing on the Website is a binding offer. The final scope and price of any service will be confirmed by the practice before treatment.

Device and product references. References to specific devices, brands, or products are for identification only and do not imply endorsement by their manufacturers.

7. Appointment and Consultation Requests

Submitting a consultation request, waitlist form, or appointment request through the Website is a request only. It does not reserve a time or guarantee an appointment until we confirm it with you directly. Joining our waitlist, including as a "founding patient," does not guarantee any particular appointment date, availability, service, or pricing. If the Website links to or embeds a third-party scheduling, intake, or payment tool, your use of that tool is also governed by that provider's own terms and privacy policy. Our practice's scheduling, cancellation, deposit, and refund policies are communicated separately and apply to any services you receive.

8. Communications

When you provide your contact information through the Website, you agree that we may contact you by email, telephone, or text message about your request and about our practice, including scheduling, updates, and (where you have opted in) promotional messages. You may opt out of marketing communications at any time as described in our Privacy Policy.

Text messages. If you provide a mobile number and opt in to receive text messages, you consent to receive automated and non-automated text messages from or on behalf of Palm Lux at that number. Consent to receive marketing texts is not a condition of purchasing any service. Message frequency varies, and message and data rates may apply. Reply STOP to opt out at any time and HELP for help. We are not responsible for delays or failures in the delivery of text messages.

9. Reviews, Testimonials, and Submissions

Reviews and testimonials that appear on the Website or our social media reflect the personal experiences and opinions of individual clients and are not representative of every client's experience. If you submit a review, comment, photo, or other content to us or tag us on social media, you grant Palm Lux a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our practice and marketing, and you represent that you have the right to grant that license. We may remove or decline to display any submission at our discretion. We will not publish identifiable patient photographs without separate written authorization.

16. Governing Law and Venue

These Terms and any dispute arising out of or relating to the Website are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. You agree that any legal action relating to the Website will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts. Any claim relating to the Website must be brought within one (1) year after the claim arises, or it is permanently barred, to the extent permitted by law.
